Rental Program Terms
1. Rent-to-Purchase Option. At any time during the rental term, the renter may elect to purchase a new instrument. Ninety percent (90%) of eligible rental payments, excluding applicable taxes and any charges not eligible under the program, for up to thirty-six (36) months may be applied as a discount against the manufacturer's suggested retail price (MSRP) of the new instrument. The Damage Protection Plan is included in the rental price and is not charged as a separate monthly plan fee. Payments made after the maximum credit period or other applicable program maximum has been reached are rental payments only. Rental credit may not be combined with or transferred to another account or used for another purpose. The new instrument must be the same type as the rented instrument and of equal or greater value. Any available rental credit must be used within thirty (30) days after the final rental renewal period ends or it will be forfeited.
2. Renter Responsibility and Routine Maintenance. The renter is responsible for reasonable care of the rented instrument, bow, and case and for loss, theft, intentional damage, or destruction not covered by Section 3. Applicable accidental damage is handled under the included Damage Protection Plan. While rental payments are current, routine maintenance and adjustments arising from normal use or weather-related changes (including peg adjustments, regluing open seams, and securing a loose fingerboard) are included at no extra charge. String replacement is not included.
3. Damage Protection Plan - Included. Each rented outfit (instrument, bow, and case) includes the Damage Protection Plan at no additional monthly plan charge. For the first covered incident of accidental damage, Wexford Violin Shop covers 100% of the eligible repair or replacement cost. For each subsequent covered accidental damage incident, the renter is responsible for a 50% deductible of the eligible repair or replacement cost. Coverage does not include loss, theft, intentional damage, or string replacement. Any repair or replacement is subject to the terms and exclusions of this agreement.
4. Size Exchange. A rented instrument or bow may be exchanged for another size at any time without an additional exchange charge, subject to availability of the requested size.
5. Credit Checks and Contact Information. Wexford Violin Shop reserves the right to perform credit checks on rental applicants as permitted by applicable law. The renter must promptly inform the shop if the rented instrument will be kept at a different address, if the billing address changes, or if the renter's contact information changes.
6. Payments and Automatic Billing. The introductory rental payment is paid in advance and covers the first four (4) months in full. Beginning four calendar months after the original rental payment date (the start of month five), the regular monthly rental fee will be automatically charged on the same calendar day as the original payment date. If a particular month does not have that day, the charge will occur on that month's last calendar day; the original billing day will resume in later months where available. Monthly payments are due in advance and are not prorated.
7. Returns and Cancellation. The rented outfit may be returned at any time. The rental account closes after the shop receives the complete outfit and processes the return, subject to any outstanding charges. The introductory four-month rental payment is nonrefundable. An outfit returned after the due date for a monthly rental period is charged the full monthly rate for that period; monthly payments are not prorated. The renter should notify the shop in writing of the cancellation/return.
8. Past-Due Payments. A rental payment more than fifteen (15) days past due will incur a $5.00 late fee. Any further recurring late fees, interest, or finance charges described in older versions of the rental agreement require owner and legal confirmation before they are included in the final contract.
9. Seriously Past-Due Accounts. Seriously past-due accounts may be referred to a collection agency or otherwise addressed through remedies available under applicable law. If no payment or mutually agreed arrangement has been made for sixty (60) days, the shop may seek payment and/or return of the rental outfit as permitted by law.
10. Renter's Assent and Payment Authorization. I have read and understand this agreement and agree to its terms. I authorize Wexford Violin Shop to charge my payment method securely kept on file for the introductory rental fee and recurring rental payments under Section 6, until the rental outfit is returned and the rental account is closed in accordance with Section 7. I agree to provide written notice of cancellation/return. Payment card numbers and CVV must not be written on this document.
